Terms of Service

These terms govern your use of the Atom website (tryatom.ai) and the Atom plugin for Adobe After Effects. By using our site, downloading the trial, or purchasing a license, you agree to these terms. If you have a separate signed agreement or order form with us, that signed agreement controls if there is a conflict.

1. What Atom Is

Atom is an AI-powered plugin for Adobe After Effects. It runs AI automations through your OpenAI account by default, with optional Anthropic support where available. Atom is available as a 7-day free trial (no account required) and as a paid one-time purchase with one year of included updates. Atom also includes local integration features, including MCP Mode, for supported local automation clients.

2. License

When you purchase Atom through our payment provider (Polar.sh), you receive a personal, per-user license unless an order form says otherwise. This means:

  • The license is tied to the email address used at checkout and is seat-limited. Free a seat before moving computers via Settings → Account → Deactivate device.
  • You may use Atom for both personal and commercial projects.
  • Your purchase includes one year of updates. Any version released during that year is yours to keep permanently.
  • After one year, you can continue using your current version indefinitely or pay an optional upgrade fee for another year of updates.
  • For team or enterprise purchases, each assigned user needs a seat and the customer is responsible for managing seat assignment and use.

You may not:

  • Distribute, resell, sublicense, or transfer your license to others.
  • Share your activation credentials with others. Each user needs their own license.
  • Reverse-engineer, decompile, or modify the software.
  • Use Atom in violation of any applicable laws.

3. Payments & Refunds

Payments are processed by Polar.sh. Pricing is displayed at the time of purchase and may change without notice (existing purchases are not affected). You must be at least 18 years old or have parental consent to make a purchase.

Enterprise purchases may be handled through an order form, invoice, purchase order, or other written purchasing process agreed by both sides.

4. AI Providers & Third-Party Services

Atom requires you to authenticate with OpenAI or Anthropic to run AI automations. These are separate services. You are responsible for:

  • Authenticating your AI provider account
  • Any costs associated with AI usage billed by OpenAI or Anthropic
  • Complying with your AI provider's terms of service

Atom's optional image generation feature uses OpenRouter, a separate service. You are responsible for any costs associated with OpenRouter usage.

We are not responsible for the availability, performance, or pricing of any third-party AI provider. Atom also runs inside Adobe After Effects. We are not affiliated with Adobe, and compatibility depends on their versions and updates.

5. Your Creative Output

Work you create using Atom is yours. We make no claim to any content, expressions, animations, or projects you produce with our plugin. You are responsible for reviewing all AI-generated changes before applying them to your projects.

6. Privacy, Security & Data Processing

Our Privacy Policy, Security Overview, Subprocessor List, and Data Processing Addendum describe how Atom handles personal data, security, and enterprise data processing.

We will treat non-public customer information as confidential and use it only to provide, secure, support, and improve Atom, or as required by law.

7. API & Integrations

Atom does not currently offer a hosted public API. Atom does offer MCP Mode, which starts a local-only integration server on the customer's computer so compatible local tools can control After Effects through Atom while the Atom panel is open.

You are responsible for the tools, scripts, agents, and automations you connect to Atom.

8. Intellectual Property

The Atom plugin, website content, branding, and code are owned by Atom (Davey Design). Purchasing grants you a license to use the plugin. It does not transfer ownership of the software or its intellectual property.

9. Acceptable Use

You agree not to:

  • Use Atom or our site in any way that violates applicable laws.
  • Use Atom to generate malware or harmful code.
  • Attempt to interfere with, disrupt, or overload our infrastructure.
  • Scrape, crawl, or programmatically access the site beyond normal browsing without permission.

10. Disclaimer of Warranties

Atom is provided "as is" and "as available." We do not guarantee that:

  • The software will be error-free or uninterrupted
  • AI-generated code or expressions will be correct or suitable for your purposes
  • The software will be compatible with future versions of After Effects

We recommend saving your work before using Atom's automation features.

11. Limitation of Liability

To the fullest extent permitted by law, Atom and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of (or inability to use) our plugin, site, or services, including project corruption or unintended AI-generated changes. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

12. Support

We provide reasonable email support for active customers. Unless a signed agreement says otherwise, Atom does not include guaranteed response times, uptime commitments, or service credits.

13. Termination

We may revoke your license if it is being shared or redistributed in violation of Section 2. Upon termination, you must stop using the software and delete all copies. If we terminate your access without cause, we will provide a full refund for your purchase.

14. Changes to These Terms

We may update these terms from time to time. When we do, we will revise the "last updated" date above. For material changes that affect your rights, we will make reasonable efforts to notify you. Continued use of our site or plugin after changes constitutes acceptance of the updated terms.

15. Governing Law

These terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law rules. Any disputes arising under these terms will be resolved in the state or federal courts located in California unless a signed agreement says otherwise.
